Vaping in Mexico – Laws and Regulations
First things first, Mexico has some pretty strict regulations on vaping. Back in October 2022, the country banned the sale and distribution of vapes and e-cigarettes nationwide. This includes devices with both nicotine and non-nicotine substances.
Now, though, there's a blanket ban on e-cigarettes and vape products, which also includes heated tobacco products and nicotine (vape) liquids.
These products can no longer be sold in Mexico, and it's not legal to bring them into the country as a tourist, either. UK Foreign Travel Advice cautions that these products will be confiscated upon entry to into Mexico, and steep fines may be assessed on the spot.
Can Tourists Vape in Mexico in 2026?
The short answer is NO. As mentioned, customs officials are instructed to remove any vaping devices, whether disposable or reusable. Although some resorts or hotels may be more relaxed in private areas, public vaping (and smoking) is off-limits, so leave your vape behind to avoid any legal troubles.
Do not buy vape products on the black market either, as there are always safety risks associated with unlicensed and unregulated products, in addition to their illegality.
What Happens if You Get Caught with a Vape in Mexico?
If you get caught with a vape, confiscation and/or a fine is the most likely outcome. Carrying large quantities of vapes could lead to more serious consequences, and could be interpreted as intended for sale on the illegal market.
Using Vape Alternatives When Travelling
If you rely on nicotine, there are several legal smoke-free alternatives that you can use while travelling in Mexico. Nicotine pouches, strips, and gum are still legal, but many local reports suggest that they've become increasingly difficult to find in convenience stores and pharmacies.
These options provide a discreet and convenient way to satisfy nicotine cravings without breaking Mexico's strict no-vaping laws. Because these products do not produce smoke or vapour, they are generally allowed in most public spaces where vaping and smoking are not. Before travelling, check for availability at your destination to ensure you have what you need. Many travel experts suggest bringing only a reasonable amount for personal use to avoid giving the impression that you intend to sell them.
Is It Illegal to Vape in Mexico?
As of January 16, 2026 - YES. Both the sale and import of vapes are illegal, and personal use could land you in hot water, too. You're likely to face confiscation of your device and a fine at customs when entering Mexico with any vape products. The government sees vaping as a public health issue, which is why strict rules exist.
Can You Smoke in Mexico?
If you’re a smoker, you’ll find that smoking is also heavily restricted. The World Health Organization reports that, as of 2023, Mexico has a comprehensive ban on smoking in public places. This includes (but isn't limited to) hotels, beaches, parks, and sports stadiums. With some of the world's strictest smoking and vaping regulations, it's important to smoke ONLY in designated zones. Your hotel staff or a local guide can advise you.

So, can you vape in Mexico? The answer is NO, and you'll want to be careful to avoid any legal hiccups while you're there. Bringing devices into Mexico or buying them from unlicensed, black-market sellers is illegal and can see you detained and fined. Always check the latest regulations before you travel.
